Ok, but it doesn't say how or why they believe that the bar was playing the music illegally.... by the looks of the pictures they show one of the discs in question so to me it would appear that they do have a legally purchased library of songs.... I'd fight the accusations too.

When/If he wins he should counter sue for his legal fees.

by the looks of the pictures they show one of the discs in question so to me it would appear that they do have a legally purchased library of songs.

It's that old lady that owns the karaoke store showing the disc, while they say "This is one of the discs with toxic on it she bought from her distributor, with the copyright label on it"

I'm going to try and dig up the case on the spokane .gov websites. I want to see if I can talk to the labels, see what's going on.

I'm surprised there's not this one loudmouth, annoying, pot calling the kettle black KJ up there that you and I happen to know, that doesn't have the inside scoop on this. It's his area, he should know the place, anyways.

I have a really big feeling this might have been one of those hard drive cases. I've talked to several local karaoke bars with pre-loaded CAVS systems, pre-loaded with a ridiculous amount of songs and no originals. When a hard drive is pre-loaded with SC songs and no original SC's "ARRR IT BE SMELLING OF FISH YE MATEY" you know damn well something isn't right.

Basically these club owners had thought they had legit purchased thier songs/systems for $2500, and no amount of reasoning would make them see things right.

This is what I preach,

KEEP YOUR ORIGINAL DISKS, NOT YOUR RECIEPTS, NOT YOUR JEWEL CASES, BUT YOUR ORIGINAL CDG'S ANYWHERE YOU TAKE YOUR SHOW. PROVE YOU OWN IT BY BEING ABLE TO BEAT THEM OVER THE HEAD WITH IT ON THE SPOT.

Well, looks like a false alarm to me...appears to be an ASCAP lawsuit. You legal types who want to read the complaint, click here for the PDF...

.....and if you're going to bring them with you anyway.....:sqlaugh::sqcool:

BTW- How would one prove the legailty of each downloaded MP3 track if it came to that?

Also, being charged isn't the same a found guilty. The few cases that have gone to court have pretty much been nuisance suits.

BTW, Toxic is put out by virtually every big and little mfr. around. It's gonna be hard to place responsibility even if it WAS unlicensed.....

I use one paypal account for all purchases and can pull up my paypal account in case someone scrutinizes if I paid.

I realize you are all high and mighty about karaoke but are you not breaking the laws you preach by recording your singers and broadcasting it on the internet?

OK i'll take the bait.

My stream is sponsored by AOL / TW and between AOL's sync license agreements and Time Warners just straight up copyright on damn near everything i'm nice and covered.

Here is my server address.
205.188.215.229

Do a NSlookup. See who owns that server. You can use www.dns411.com to do it.

AOL has a blanket license agreement across all servers that they run. They run many servers. Mine's on port 8014, so try changing ports, and seeing how many servers they run. http://205.188.215.229:8014, http://205.188.215.229:8020, just try random ones.

I am the only video show they sponsor. They are currently not accepting applications for any more. My show is loved so much by AOL/Nullsoft/Time Warner that despite all the recent layoffs (They also cut off about 100 sponsored radio stations) I was one of the lucky few that escaped the axe.

Doesn't it make you wish you were me?

Now that we've covered live stream, let's move onto my VOD.

The same blanket licenses also apply to thier uncut videos.
http://uncutvideo.aol.com/users/sevenbamboovideo

Last year, and it will be ongoing in 2008 VOD websites like youtube have been scrambling to obtain SYNC and mechanical licenses so users can use artists compositions in thier videos.

So while it might be prohibitavely costly for you to start a live stream, there's nothing from preventing anyone from uploading clips of thier singers to any of these new VOD sites.

The karaoke companies know this. This is why MMogroup is having us setup our system at NAMM 2008. There will be a MMOgroup sponsored karaoke contest at NAMM, ran on autokdj, with our automagical youtube compatibility, inside the MMogroup booth.

And how dare you compare me to a pirate. Trying to pick a fight with me just shows me how immature you are, grow up.

My 1st mistake was taking a thread slightly off target, so that is my bad.

Ah no, I didn't use any negative words or call you any names. I just asked for clarification.

Apology accepted, heh you're up late, must be caffiene wired like me :)

Everyone involved in our project knows its a huge deal. The main reason is our stats.

Sorry for the big ass picture but that tags link is gonna change...

As you can see, it's huge. We're generating tons of traffic for AOL. One, tiny, small little karaoke bar has taken over AOL's youtube competitor.

The karaoke companies are aware of this. They're aware of the fact we're the only full featured karaoke system with this kind of compatibility.

Is each and every track listed on the receipt, or is it a receipt of total sale?

Is each and every track listed on the receipt, or is it a receipt of total sale? Since MP3 tracks can be acquired as singles, each track would have to be listed. Of course, we don't know for sure, whether MP3 or disc, whether the mfr. is properly licensed. We only have their say-so.

...and CONGRATULATIONS on the success of the show! {{{{grumble...PC-head...grumble}}}

If I'm reading that correctly, it is a total order receipt, with no indications of the exact tracks purchased. I Dunno.... And again, none of us have seen our suppliers licenses either...

Either way, I wouldn't worry about it. Like I said, we are talking about orgs that are losing juice daily...

OOPS! My bad. Next time I'll read with BOTH eyes..

Well, IF your supplier IS licensed for all tracks, you're covered. If not, YOU are STILL covered...
