Hi, I am a karaoke manufacturer from England and here is what its like for a manufacturer in this country.
We have to submit a list of songs we wish to make on karaoke to MCPS who then send a form back to confirm which songs are registered with them. You can only produce tracks that are registered with them.
Once they give their approval the discs are made.
Because the backing tracks are not the original artist there are no other licences or permissions required.
Copyright of that disc belongs to the manufacturer and the rights of what happens to the disc also belongs to the manufacturer including format shifting.
MCPS say it is not their responsibility, so in response to this I have given permission for anyone who has an original Laughing Gnome Karaoke disc in the UK , to convert it to any format they choose.
Future discs will also have a statement on the sleeve confirming this.
That is what it is like here in the UK. Other manufacturers don't seem to want to allow people who have bought the original discs to be allowed to convert them, but we are in 2008 and they need to change with the times.

I have quickly read through some of the postings here and would like to add the following short notes:

The Sunfly "offering" of allowing a license to add your CDG content to a hard drive is most likely based on the PPL (Phonographic Performance Limited) license which allows DJs to put their libraries on a hard drive. HOWEVER there currently is not a similar license for karaoke files, so Sunfly's "offer" could only "allow" you the right to copy THEIR version of music to a hard drive; you wouldn't have the underlying publishing rights that need to be granted by PPL or the MCPS.

As mentioned by Big Jim1 on December 19th, David at AVA and I met with MCPS/PRS (Mechanical Copyright Protection Society/Performance Rights Society) on December 11 and put a proposal together to create a HARD DRIVE license whereby pre-loaded hard drives could be legally sold (there is currently a 30 song limitation to selling songs on any physical medium). Further, we proposed having NO FEE for allowing KJs to load their LEGALLY PURCHASED CDGs onto a hard drive IN EXCHANGE for signing a Code of Ethics Pledge and "registering" with a Professional KJ organization that manufacturers and some KJs in both the US and UK are trying to organize.

Also, Big Jim, loading CDGs to hard drives systems IS NOT LEGAL in the US either, but US publishers have not challenged the practice. US Karaoke Manufacturers also control the rights to this and Sound Choice has never authorized the transfer of CDGS to hard drives.

Sound Choice is consulting with AVA on their hard drive solution and subsequent download solution and working with MCPS to create licenses for both that are valid in the UK and US markets. Together, with AVA and other manufacturers we hope to be able to provide KJs with legal, relatively easy, cost effective solutions to build and maintain and update their hard drive libraries.

One other Item. When we discuss so-called reputable sources, and the impression they give that their music is licensed:


Ace is being sued by Sony for 30 MIL.

So to repeat: Unless you receive a copy of the license for each and every track that you buy, you have absolutely NO WAY of knowing if the tracks you buy from ANY source are licensed or not....
 


This part is tough:

What Fair Use Would Not Privilege:
1. Copying CDG discs from friends or family and using those unpaid for and copied discs for commercial purposes.
2. Selling or otherwise distributing unlicensed copies of CDG discs.
3. Buying hard drives that contain unlicensed CDG songs (usually for pennies per song, such as have been sold on eBay with 35,000 songs in the range of $400).
4. Downloading MP3+G or other digital format karaoke songs from an Internet site that does not have the right to digitally distribute the songs you purchase.
5. Knowingly performing karaoke songs that are not properly licensed by the copyright owners.
6. Space-shifting (format-shifting / importing) CDG discs onto a hard drive, then using both the original discs and one or more hard drive copies at the same time. A KJ must purchase a full set of CDG discs for each copy on a hard drive.


The fact is that there are those who lie. Getting someone's word on things is scary. I am backing off of my desire to be a KJ of any size until this is clearer.
 


Good Stuff! I guess the key word is "knowingly" and the complainant being able to prove it. I've bought CDGs from a bunch of different companies, all licensed as far as I know. A lot have been pulled from the market, or the mfr. got sued. However, I have no definitive list of every track in question, and to my knowledge, none has been released. I'm talking about licensing here, and new discs, not illegal copies.

So: 1) To repeat, unless you can get a copy of the license for each and every track you buy, there is absolutely no way of knowing if it's licensed or not.

2) Since no supplier or mfr. sends these copies, there is virtually no way of proving whether it's "knowingly" or not if the one can produce receipts.

3) PC download laws are still unclear, and seemingly ever-changing, so it's really a matter of whether the host feels comfortable enough to use downloads, at least until these laws are clarified, and downloads also come with license copies for each and every track.

Ernie what are you talking about? I have no record of you ever being banned.
