To many ads? Support ODJT and see no ads!
There is actually a DJ in my area advertising on his site that he can play music on demand with his Spotify subscription..... It's just sad.

You'll see a lot more of that too in the near future. Remember when Napster came out? DJ's for miles around advertised 100,000+ songs. I counteracted that with the average reception is between 60 and 80 songs on the outside 100 if it's a real long day. What do you do with the other 99,900?
 
The thing is, if the DJ doesn't. the people in attendance will. There are countless "legal" sources for music these days. A DJ saying "I don't have that.", is laughable to most people. You have to roll with the changes.

Oh I agree. Especially with the legal sources available I find it laughable he is advertising his source as Spotify. I have met this DJ in person on several occasions and he is a piece of work to put it politely.
 
This is a great video on built in functionality but addresses nothing about the legality of using it at an event you are getting paid for. In Spotify's Terms of Service it states..

We grant you a limited, non-exclusive, revocable licence to make use of the Spotify Service, and a limited, non-exclusive, revocable licence to make personal, non-commercial, entertainment use of the Content (the “Licence”). This Licence shall remain in effect until and unless terminated by you or Spotify. You promise and agree that you are using the Content for your own personal, non-commercial, entertainment use and that you will not redistribute or transfer the Spotify Service or the Content.
Maybe I am just reading it differently.
 
Maybe it's that gray area..like 'public performance' or needing a license to play music..sure the VENUE needs it, but last I checked a back yard, kindercare, the local park, etc don't have such licenses.

It's called a 'private party' because i guess there isn't an admission charge? But a prom certainly has one - no ticky to attendee!

And as the entertainment you are being paid to provide and play the music - that in every definition is indeed commercial use of the music!

And at car cruises or many similar events it's most certainly as public as public can be! Anyone and everyone is invited to attend, no private anything about it.

So therefore if you don't need an ascap/etc license...it's not a public performance, not a commercial use...??

I tried it..sucked. A lot of stuff isn't on spotify, you must have a SOLID wireless/internet connection, it doesn't seem to DL it, or as least I couldn't make that happen.

Like tonight, i'm playing a teen dance at a county grange camp in the midst of a state park in WV...there be no internet there of any kind (been there before). I know the kids will ask for stuff I don't have...and well, won't be able to get.

What has worked for me is my phone- DL to it (spotify and now applemusic) and play a song or 2, rarely more in a whole night, that way.

Like at teh prom at 1:25 am with a kill the music time of 1:45 they say to me "we ALWAYS play this song at the end of prom..I know we didn't tell you about it...".. not a song I'd ever heard of, a band I'd ever heard of.

Well, maybe, that is Vitamin C ( Colleen Ann Fitzpatrick), Graduation is from her album titled, Vitamin C, released in 1999, Graduation was released in 2000, it reached #12 on the top 40 , 38 on the hot 100 , but her big hit was Smile off the same album.
 
Well..i've only been DJing about 3 or 4 years - so this came out well before I 'needed' it or 'collected' top hits.
It's not in a genre I prefer to listen to personally.
In 99/00 I was busy buying a house, having a kid and working. Music wasn't maybe the focus of my life then LOL.

I've gone back over most years and gotten top songs I think are dancable or work for cocktails/dinner type stuff. Had I found this song (which I have not..shame on me I suppose) I surely wouldn't have picked it up for wedding music LOL

And this is one reason I don't belong to pools - they won't have this 'old' stuff.

When I get a HS reunion for class of 98-2004 I'll 'stock up' on music of that era in more depth.

As it is I need other stuff..ignoring the fact itunes/laptop all crashed prepping for last night's gig, I missed getting Rolex, have had a few requests for Rosa Parks (yet to check that out) and last night a first time req for 'FTC Challenge".

Unfortunately this event was in a state park in WV at a Grange Camp - no wifi...barely any phone reception at all. My son was with me and he commented after 4 hours there and anohter 1/2 driving we finally hit the cell area again and his phone lit up like a christmas tree.

A private party is one that is not commercialized, open to the public and there is no profit / financial benefits for the organizers / promoters. A private party is an event with you, your family and your small circle of friends.

A car cruise/bike night? towns here have them as well as bars. Some are 'free admission' but are done to make money for the bar or merchants in a town. No different than if you are playing IN the bar than outside it.

If the event is intended for a "circle of friends", then it's private .. regardless of where it's held (including the park). If anyone can come .. even if there is no charge .. it is public and needs to have licensing addressed.

So weddings are private normally, school dances are private normally (there's always an exception out there) even with a cover charge, car cruise/bike night is PROBABLY public, if anyone can come .. unless you can make the case that all those who attend are "friends of some sort".

Whether someone will go after you is a different issue. More likely to have a restaurant/bar cited for not doing things properly than a car club.

If you are hired to play music - but have no other financial stakes in it, then you are not the beneficiary. If you perform in a park - and promote that event, then you are on the hook for licensing. Public events require licensing. A wedding in a park is a private event. The bride/groom is the host / beneficiary - but alas, they have only invited their family and friends for a one time event - and they are usually not charging to attend.

An establishment, such as a bar, uses music to get more income - this is commercial use.

I never ever tell someone that I don't have a song,,,, I feel that I am a professional dj and I should have access to every song on the planet. So I play it off that way. I take the request, and if i don't play it I just say that I had too many requests ahead of them! I usually download it with my 4g lte iPad and play it from there from 3.5 mm jack to 1/4 inch. I just fade in through my 12 channel Yamaha mixer!

If it a suckey song that I don't feel like goes with the show AND I have to play it because they are someone that is close to the check writer!!!!! Then I announce "by request". So is not my fault if this song sucks!

The other thing is, I'm not good enough that I can have too many things going on at the same time. While I have the ability to download music, it's a big distraction, so I rarely do it unless the song is one I wanted to get anyway.[emoji1]

spotify or apple music on a phone is pretty easy, not too time consuming to do.
I've not tried iTunes on a phone or tablet.
I have tried using itunes to DL a song during a wedding..MOB wanted it...not on apple music but itunes had it...what a cluster..I use 2 laptops..main for music and backup and that also runs the DMX lighting.
SO I set up a hotspot on my phone and go on backup..well, iTunes is out of date and won't function. So I switch playing over to that laptop and use the main one (which is on iTunes often) to get the song. Takes long time to DL over the hotspot..then mix back over to that laptop.

Distraction? you betcha, cause of course this is 30-40 min before the end of the night..so many requests and i really want to get this played before the night is over - and not crash or lock up a computer in the process.

Probably gonna look more into use the tablet (ipad) as second source.backup.sorta thing. I have VDJ remote on it so that should make things easier.

I always have a helper. My wife or my son is usually with me. The are not fully able to run the set without me! So I usually have them get the requests and get it que'd and ready to play!

That's a good solution. My wife always offers to go with me, but she's not much help.[emoji1] In fact, she kinda just gets in the way, so I usually decline the offer.[emoji4]
