How many of you use Itunes or Amazon? Ever read the User License? Not for public use. So you pay $2 for a song you can't legally use anyway. Most of the DJs around here do the same thing. I'd call it Standard practice.

Your lack of understanding in this matter explains your predeliction to theft.

Given the choice - I'd GLADLY pay an AVLA license to legalize the format shifting. Hell, I'd go multi-op tomorrow if that was the case! But I know more about Canadian copyright laws than 'most' Americans - but I'm not anywhere near as up to date as I wish I was.

That being said... you don't understand copyrights, licensing and EULA and the differences.

The end user licensing agreement is a contract. It has nothing whatsoever to do with licensing or copyright. And it doesn't say 'not for public use'. It says not for COMMERCIAL use.

Public performance - no matter the media - requires a public performance license from BMI, SESAC, or ASCAP. The public performance license has NOTHING to do with the EULA.

The EULA, if violated, is between you and Apple. If you violate it then it's a civil tort and not a criminal one.


I should know - I'm the only person I know of that has actually gotten a statement from an online provider of music allowing me to use their tracks in violation of the EULA - within my DJ business.

But my discussions with record labels also shows that record companies could care less about that EULA - they want the tracks bought legally, not to be shared, and public performance paid when they're used. That's it.


And you're good to not post your information publicly. I'd be willing to bet that a dozen people would be more than happy to turn you in. Although, if subpeona'd, I bet this board has information on your IP address they could use to track you down quite easily.

Next time take a plate of fries...throw on a cup of cheese curds (the white ones)....If you can't get cheese curds,,,,chunks (small) of mozza will do.

Get some good thick hot streaming beef gravy..... pour liberally over the fies and cheese....let the cheese start to melt.....you have Poutine - a Canadian delicacy....

People can find me in my local area. Again I am not worried. I am here to hang out and see what you all are about. I have been looking back at some older posts and it seems you guys have some real issues. The high priced guys you insult and drum out of here with insults and what not, and me, well I don't care what you think, but I do see a lot of pot & kettle here. I don't tell you what to do or how to price.

Do what works for you. I do what works for me. I wouldn't do half the extra stuff I see on here. Up lighting, love story and all that jazz. If you can make money doing that, go for it. But I bet there are fewer of you making an actual living at this than not. We all market as DJs, but we are all different in what we offer and how. Now, you want to say you are better than me, just like other people on here have said the same about some of you.

It's an old boys club and I'm cool with that. You are all friends and you feel threatened when someone comes to the board and challenges your status quo. This board isn't so much about improving the "industry" as just feeling good about your selves. It's an ego thing and I get that. I have been to many of your web sites, some are very well done, others not so much. Some list prices, some don't. Some don't do much of anything and some of you have none. All diverse, no set formula just what ever works for you.

I do what works for me.

I have yet to meet anyone Dj or radio that is 100% legal, you can't be 100% legal in this business. A new song comes out but the CD release is a month away and other than the radio there is no way to get the song but suddenly this new hit song is someones first song. What do you do? Do you hit up the local station and pay them for the song or download it?

Preach all you want about being legal, it's a load of BS and you are all fooling yourselves other wise. You can buy your CD subs, you can buy originals but your going to download certain remixes that are not available on CD or CD Subs but do break the copyright laws and so on.

Standard practice and don't worry the RIAA is more worried about single mothers with kids and no real job than a bunch of DJ's.

There is another solution outside of illegally downloading it.... it's called a subscription.

TM Jones aka Primecuts offers a weekly disc that brings out the top hits or soon to be hits and gets them to you sometimes before they start getting radio play as is the case in my neck of the woods.

There ain't a bride out there that is going to request a song so new that it has neither hit the radio waves or the CD shelf for their first dance anything.

Sell your line of crap elseware.
 
Ahh but Rob you dont know that we have handicap here in Canada and have to allow AVLa and the music industry to release on a promo only or Primecut sub or Multi Music sub or any of them and I can vouch for the timeliness on certain songs. Some songs wont release for us until the Radio has even been playing it for a month or two and has been my biggest complaint since moving here. On a side note if you join Primecuts here you can in fact get all your music on HD through their service and every song that releases is in your library. This service costs you a pretty penny and of course you dont own it.

Fine download it... then buy it when you can.... near as I can figure I'd bet more than 50% of his single system library or more is not legal even by Canadian law..... never mind the fact that he's admited to copying that same library what was it 8 times over... now tell me I'm being harsh on that poor Canadian and his hard luck story on the difficulties of maintaining a music library.

I never said they will ask for a song that they have never heard, that's just stupid and you should really think before you speak. Your services based on posts I have read are more like my own than anyone else I have seen here.

And I am only now getting songs that were released on the radio locally 2 months ago. Why should I go buy a bunch of original CDs when I am going to get the 1 or two songs I want, other than Lady GAGA who has had probably 80% of her CD played on air.

And yes, I have had a song that is only a couple weeks old requested as a Father Daughter dance because it had radio play only and I had to get it. I paid the local station $5 for a copy. Legal? No, but I got the song.

I'll give ya some credit as I had forgot that you were in Canada and music isn't as readily available to you on the spot....

My appologies... the Karaoke Piracy has got me hot at this point and it spilled on you...

However, I still take exception to the fact that you copy your single library over to multiple systems that can be used nightly at the same time... even you have to admit that, that is piracy even in Canada.
 
I know that its the only way a multi can survive I know that the only one multi here in town does exactly the same as Discount does the others dont even have a subscription so 100% illegal. Many of the single Ops I know are pretty much legit.
 
Joker - Every multi-op I have seen has copied CD's of ERG - Super Traxx and Knock out Hits. I have even seen Promo-Only burns. I know two DJs personally that have complete sets in MP3.

What I am doing is Standard practice. virtually everyone does it. I know one company I used to work for, did exactly the same thing, got an AVLA complaint and it went as far as a phone call. No follow up, no one went to the office to look and all they had to do was walk into the guys shop to see stacks of binders all with copied CDs.

No one cares, You care, a couple others care, but that's because your competition. Clients don't care, they have no problem handing me a burned CD to play a song I don't have. You want change? You go tell the clients, when they start to care, I might start to care.
